KMH Terms of Use

1. Agreement to Terms
Welcome to KMH (“Company,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of our website, services, and any related tools, platforms, or digital content (collectively, the “Services”).
By using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please discontinue use immediately.
2. Eligibility
To use our Services, you must:
Be at least 18 years old (or the legal age of majority in your jurisdiction);
Have the authority to enter into a binding agreement; and
Use the Services in compliance with these Terms and all applicable laws.
If you are using KMH Services on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.
3. Services Overview
KMH provides website creation, hosting, branding, and digital support services designed to help individuals and businesses establish an online presence. Depending on the plan you select — Base, Growth, Gold, or Platinum — the specific features and tools available to you may vary.
We reserve the right to modify or discontinue certain features at any time, with or without notice, provided such changes do not materially degrade the services you’ve already paid for.
4. Account Registration
To access certain Services, you may be required to create an account. You agree to:
Provide accurate and complete information;
Maintain the confidentiality of your login credentials; and
Notify KMH immediately of any unauthorized access or security breach.
You are responsible for all activities that occur under your account.
5. Payments and Subscriptions
a. Billing Terms
KMH offers tiered plans:
Base Plan — $59 setup, $29/month
Growth Plan — $59 setup, $59/month
Gold Plan — $79 setup, $79/month
Platinum Plan — $120 setup, $120/month
All payments are processed securely via third-party providers. Subscription fees are billed monthly and renew automatically unless canceled in advance.
b. Cancellation and Refunds
You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of your current billing period. Setup fees are non-refundable.
KMH reserves the right to suspend or terminate access for nonpayment.
6. Intellectual Property
All content, software, logos, graphics, and materials provided by KMH are the property of KMH or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, distribute, modify, or create derivative works from KMH materials without express written consent.
You retain ownership of any content or materials you upload to your KMH-built website but grant us a limited license to host, display, and distribute that content for the purpose of providing Services.
7. Acceptable Use Policy
You agree not to use the Services to:
Violate any local, state, national, or international law;
Post or transmit fraudulent, defamatory, obscene, or infringing content;
Attempt to gain unauthorized access to systems, networks, or user data;
Interfere with or disrupt the integrity or performance of the Services;
Use the Services for spam, scams, or malicious code distribution.
Violation of this policy may result in suspension or termination of your account without refund.
8. Limitation of Liability
To the maximum extent permitted by law, KMH and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising out of your use or inability to use the Services.
Our total liability for any claim relating to the Services shall not exceed the amount you paid to KMH in the preceding three months.
9. Disclaimers
The Services are provided on an “as-is” and “as-available” basis. KMH makes no warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee uninterrupted access, error-free performance, or complete security beyond commercially reasonable measures.
10. Termination
KMH may suspend or terminate your account at any time if:
You violate these Terms;
You fail to pay subscription fees; or
We discontinue our Services.
You may also terminate your account at any time. Upon termination, your right to access our Services immediately ceases.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles.
Any disputes arising under these Terms shall first be attempted through informal resolution. If unresolved, disputes will be handled through binding arbitration in Virginia, unless otherwise required by law.
12. Modifications
KMH reserves the right to update these Terms at any time. Updates take effect immediately upon posting. Continued use of the Services after changes means you accept the revised Terms.
